TERMS AND CONDITIONS OF USE TheSharehouse.co.uk & TheSharehouse.com.au owned, Operated and maintained by Amoreking Pty Ltd 1. Introduction The Website provides an online community platform that enables users to create, publish, browse, search, and interact with Listings, including: Rooms or rental properties for rent Listings by people seeking a room Parking or storage spaces offered or wanted Pre-loved items for sale or giveaway (together, the “Services”). By accessing, registering on, or using the Website or the Services, you agree to be bound by these Terms and Conditions of Use (“Terms”). We may modify these Terms at any time in our sole discretion. Updates take effect when posted on the Website. Continued use of the Website constitutes acceptance of updated Terms. 2. Definitions In these Terms: “Account” means a registered user account on the Website. “Content” means photos, graphics, text, videos, prices, descriptions, or location data submitted by users. “Listings” means any advertisement or posting on the Website, including: rooms for rent room wanted parking/storage offered or wanted pre-loved items “Personal Data” means personal information as defined under the Privacy Act 1988 (Cth) and any equivalent legislation. “User”, “you”, or “your” means any person accessing or using the Website. All Listings are treated equally under these Terms unless expressly stated otherwise. 3. Creating and Managing Listings 3.1 Responsibilities of users who upload Listings If you upload Content or create a Listing: Accuracy You must ensure Listings are true, accurate, lawful, and not misleading. No duplicated or spam Listings. Updating listings You must update or remove Listings promptly when: the room is rented, you no longer seek a room, the parking/storage space is no longer available, the item is sold or given away. Your own due diligence You are solely responsible for assessing any user who contacts you. TheSharehouse does not vet, verify, or conduct identity, background, police, credit, or character checks on users. Legal compliance (for accommodation Listings) If your Listing involves accommodation (room/property rental or room wanted), you must comply with all relevant laws in your jurisdiction, including: tenancy laws right-to-rent laws (UK users) residency rules local council, zoning, HMO (House in Multiple Occupation), or planning regulations safety requirements and property standards You are responsible for your legal obligations as a landlord, licensee, agent, or tenant. 3.2 Our rights to manage Listings We may, at any time and without notice: edit, hide, or delete Listings or Content that violate these Terms suspend or restrict Accounts remove inactive Listings remove duplicated Listings remove Listings we consider inappropriate, unlawful, misleading, or harmful report suspicious or unlawful activity to authorities TheSharehouse has full discretion regarding the management of Listings. 4. Users Browsing or Contacting Listings If you browse or respond to Listings: Your own assessment You alone are responsible for determining the suitability of Listings, accommodation, users, items, or spaces. Property inspections You should view accommodation in person before agreeing to move in or pay money. Agreement compliance Any rental or transaction agreement must comply with local, state, and national laws applicable in your jurisdiction. No verification by us We do not inspect rooms We do not verify item condition We do not check addresses We do not confirm identities We do not guarantee the truth of any Listing You act at your own risk when dealing with other users. 5. Accounts 5.1 Registration Requirements To upload Content or create Listings, you must: Provide true, accurate, and current information Be at least 18 years old, or have permission from a parent/guardian Securely maintain your login details You must not: use another user’s Account allow someone else to use your Account misrepresent your identity 5.2 Account Deletion or Deactivation You may: delete your Account at any time (all Listings will be removed) deactivate your Account to pause activity and reactivate later 5.3 Suspension or Termination We may terminate or suspend your Account if: you breach these Terms your actions may harm us, other users, or our reputation we are legally required to do so 6. Use of the Website You must not: misuse or disrupt the Website reverse-engineer, hack, or attempt unauthorised access upload viruses or malicious code scrape or harvest data send unsolicited advertising impersonate others upload unlawful, defamatory, obscene, abusive, or discriminatory material encourage illegal activity upload Content that violates any rights (IP, privacy, property, etc.) engage in fraud, scams, or misleading conduct use the Website for commercial activities unrelated to Listings We may take action (including reporting to authorities) if improper use is detected. 7. Payments and Future Paid Features At present, all core Services and Listings on TheSharehouse are free. In the future, we may offer optional paid features, such as: featured or boosted Listings subscription plans promotion or visibility upgrades verification services additional advertising tools By using future paid services, you agree that: payments will be processed by third-party providers (e.g., Stripe, PayPal) refunds may not be available unless required by law upgraded features are not guaranteed to produce results We may modify paid features, pricing, or availability at any time. 8. Content Rules When you upload Content, you confirm that: you own it or have permission to use it it does not infringe any third-party rights it does not contain illegal, harmful, defamatory, or otherwise inappropriate material 8.1 License You Grant Us You grant TheSharehouse a worldwide, royalty-free, transferable, sublicensable licence to: use, reproduce, adapt, publish, modify, display, and distribute your Content promote the Website (e.g., social media, advertising, partner platforms) 8.2 Monitoring and Removal We may access, review, store, or remove Content or messages if needed to: enforce these Terms protect users comply with law maintain Website safety and integrity 9. Reviews and Feedback Users may leave reviews or feedback. By doing so, you agree: your review is genuine and based on real experience we may display it publicly reviews may include your first name, initial, and city we may edit or remove inappropriate reviews Reviews must not contain: advertising or promotional material defamatory, abusive, hateful, or illegal content misleading or fraudulent claims personal attacks or harassment 10. Transactions Between Users TheSharehouse: is not a party to any transaction or tenancy agreement does not act as a landlord, agent, or broker does not handle payments, deposits, or bonds does not mediate disputes is not responsible for the condition, legality, or suitability of any property, item, or space All agreements are strictly between users. 11. Intellectual Property Rights We own all intellectual property in the Website (excluding user Content). You must not copy, reproduce, distribute, modify, or exploit Website materials without written permission. You may share blog or article content for non-commercial purposes only if you credit TheSharehouse. 12. Indemnity You indemnify and hold harmless Amoreking Pty Ltd and its officers, employees, and agents from all claims, losses, expenses, damages, or liabilities arising from: your use of the Website your Content or Listings your breach of these Terms disputes with other users your violation of any law or rights of third parties 15. General Terms 16.1 No agency Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and TheSharehouse or between users. 16.2 Entire agreement These Terms constitute the entire agreement between you and us. 16.3 Severability If any part of these Terms is invalid or unenforceable, the remainder remains in effect. 16.4 Governing Law These Terms are governed by the laws of the State of Victoria, Australia.
